A representative of U.S./international law enforcement will address the leakage of looted material to the U.S. and international art markets and government efforts to interdict hot material. Representatives of U.S. auction houses and private galleries will address the KYC and AML procedures used by the private sector to avoid handling looted material.

The Future of the Criminal Legal System: How Should a Multidoor Criminal Courthouse Operate?

As the push for criminal legal reform continues around the world and the impact of progressive prosecutors or bail reform is still being unpacked, the future of the criminal legal system is up for debate. Much like the creation of the multidoor civil courthouse—with options for negotiation, mediation, and other processes—what should a multidoor criminal courthouse look like in the future? How should evolving processes of restorative justice, problem solving courts, diversion sentencing, bail reform, and plea bargaining be structured and integrated in the future? What should the role of judges, prosecutors, defense attorneys, crime victims, defendants and the public be in this new future? This symposium will present a variety of papers addressing the issue of the future criminal legal system with an eye toward more effective system design and problem-solving for all players.

Please join the Institute for the Study of Genocide and the Cardozo Law Institute in Holocaust and Human Rights for the biennial Lemkin Award, which honors Raphael Lemkin, the originator of the term “genocide” and exponent of the UN Genocide Convention. The award recognizes the best non-fiction work focusing on genocide, crimes against humanity and other gross human rights violations, and on strategies of prevention.

Kuan (Partner, Emery Celli Brinckerhoff Abady Ward & Maazel LLP) and Professors Alex Reinert and Betsy Ginsberg will serve as mock judges for Keegan Stephan (Associate, Beldock Levine & Hoffman LLP; Cardozo School of Law, Class of 2019), an attorney who will be arguing an appeal on behalf of the plaintiff in Linton v. Zorn, which is currently pending in the United States Court of Appeals for the Second Circuit (Case No. 22-2954).

A Pluralist Theory of Constitutional Justice by University Professor Michel Rosenfeld (Oxford University Press 2022) develops a pluralist approach leading to the “justice essentials” designed to meet the above challenge and to reinvigorate liberal constitutionalism.
