Abstract
The note examines the conflict between the European Community's (EC) waste shipment regulation and free market principles, arguing that while the regulation aims to protect the environment, it inadvertently creates market distortions and may lead to increased environmental harm. The regulation, influenced by the Basel Convention, prioritizes environmental protection over free trade, potentially undermining the EC's internal market and causing unintended economic and environmental consequences.
