Punishment Without Trial: Why Plea Bargaining Is a Bad Deal

When Americans think of the criminal justice system, they picture a trial. The right to a trial by jury is supposed to undergird our entire justice system – but that bedrock constitutional right has all but disappeared thanks to plea bargaining. In 2018, more than 97 percent of defendants pleaded guilty.
In Punishment Without Trial: Why Plea Bargaining Is A Bad Deal, Carissa Byrne Hessick makes the case against plea bargaining and illustrates why we need to fix it if we ever hope to achieve lasting criminal justice reform.

A Screening of Attica and a Conversation With Tyrone Larkins and Akil Killebrew
Cardozo Criminal Defense Clinic, Cardozo Public Service Scholars Program, Cardozo Civil Rights Clinic, and E. Nathaniel Gates Scholars
Join us for a screening of the film in conjunction with a panel discussion featuring Tyrone Larkins and Lawrence Akil Killebrew, both of whom are formerly incarcerated people and were in their early twenties when they were serving their sentences at Attica Prison in 1971. They are survivors of the brutality that was witnessed at Attica between September 9 and September 13, 1971.

The COVID-19 Pandemic, Diversity and Inclusion, and the Practice of Law

The COVID-19 pandemic has exposed preexisting weaknesses in many areas of life and the law. In April 2021, the ABA published a study entitled Practicing Law in the Pandemic and Moving Forward: Results and Best Practices From a Nationwide Survey of The Legal Profession. The results of this study confirmed what many women and people of color already knew – standard approaches to the workplace do not serve goals of diversity and inclusion, especially during times of great stress and financial uncertainty.
On November 8th, the Burns Center will host the authors of this study and JoAnne Epps, Senior Advisor to the Temple University President and Professor of Law, to discuss the study's findings and whether there are lessons from the past 18 months that the legal profession can use to pivot to a more inclusive future.

Lawyers Behaving Badly: Episode 1 - The Executive Branch
Jacob Burns Center for Ethics in the Practice of Law
On November 4th, the Burns Center will host Cardozo Professor Kate Shaw for a discussion about the special risks that arise when lawyers advising the executive branch provide erroneous advice on matters of constitutional and federal law.
Prompting this program are the revelations that John Eastman - a former law school dean - and Assistant Attorney General Jeffrey Clark advised the White House that the results of the 2020 election could be set aside. What duties did Eastman and Clark owe as a matter of professional responsibility? Who can now respond to Eastman's and Clark's violations of those duties? Are the guardrails that constrain lawyers advising the executive branch sufficient? These and other questions will be addressed.

Afghanistan – What’s at Stake: National Security, Human Rights, and the Rule of Law
Cardozo International & Comparative Law Review
Panelists will discuss the history of the Afghan legal system and the obstacles to development. Is democracy a prerequisite to a rule of law system? How, if at all, did Afghanistan’s 2004 Constitution change the legal landscape? Panelists will also discuss peacebuilding strategies and whether international law can be used as leverage over the Taliban, which is now in control of the government. If the Taliban thwarts monitoring efforts about suspected human rights violations, what can be done by the international community as a response?
