Abstract
The article challenges the constitutionality of Texas dividing into four new states under the Four New States Guaranty, arguing that such a division violates the equal footing doctrine and the constitutional scheme for state admission. It contends that Congress cannot grant advance consent for statehood to territories not yet in existence, as this undermines the principles of equal sovereignty among states. The analysis focuses on the historical and legal context of the Texas Annexation Resolution of 1845 and its implications for modern proposals to divide Texas.
