Abstract

The article addresses the legal ambiguities surrounding detention in non-international armed conflicts (NIACs), highlighting the lack of explicit rules under international humanitarian law (IHL) and the challenges posed by the extraterritorial application of human rights law. It critiques the argument that detention authority can be implied from the right to target under IHL and advocates for reform to establish clear legal frameworks for detention in NIACs, ensuring compliance with human rights protections.
